Terms & Conditions

These Terms govern your relationship with the operator of the informational website available at https://theville-au.com in relation to your use of The Ville content and associated services on that site. By accessing or using theville-au.com you agree to be bound by these Terms as amended from time to time. These Terms take effect on and from 1 January 2025 and are intended to remain in force, subject to updates, through at least 31 December 2026.

Definitions

In these Terms, unless the context requires otherwise:

  • "Website" means the website located at https://theville-au.com, including all pages under that domain, which hosts The Ville and related informational content.
  • "Operator" means the entity or entities responsible for operating and administering the Website and its content. The Operator is an independent online publisher and is not Breakwater Island Limited, The Ville Resort-Casino, the Morris Group, nor any related body corporate.
  • "The Ville" means the specific review and informational project about The Ville Resort-Casino in Townsville, Queensland, as configured on the Website.
  • "User", "you", "your" means any natural person who accesses, browses or otherwise uses the Website.
  • "Player" is used generically to describe individuals who may visit or gamble at land-based casinos or other gambling services operated by third parties. For clarity, no gambling as a Player takes place on the Website itself.
  • "Account" means any user profile or registration that may be created on the Website (if and when available) for accessing additional features such as newsletters, saved reviews or comments. It is not a gambling account and cannot be used to place real-money bets.
  • "Content" means all text, data, reviews, graphics, logos, images, videos, software, code, tools and other materials published on or accessible via the Website, including but not limited to information about The Ville Resort-Casino, Queensland regulations, and guidance for visitors.
  • "Third-Party Service" means any external website, casino (online or offline), bookmaker, affiliate partner, reservation platform, or other service provider that is linked to, described on, or otherwise referenced by the Website, including The Ville Resort-Casino at Sir Leslie Thiess Dr, Townsville City QLD 4810, Australia.
  • "Bet" means any stake, wager or gamble placed by a person with a Third-Party Service. No Bets can be placed on or through the Website.
  • "Wager" has the same meaning as Bet.
  • "Bonus" means any promotional credit, free play, voucher, offer, discount, loyalty reward or other incentive that may be offered by a Third-Party Service, including any land-based promotions run by licensed casino operators such as Breakwater Island Limited. The Website does not itself grant or pay Bonuses.
  • "User Content" means any information, comments, reviews, feedback, ratings, images or other material submitted or uploaded by a User to the Website.
  • "Applicable Law" means all laws in force in the Commonwealth of Australia and the State of Queensland that are relevant to your use of the Website, including but not limited to consumer law, privacy law, intellectual property law, defamation law and, where relevant to informational accuracy, the Casino Control Act 1982 (Qld) and associated regulations.

Important clarification: The Website is an informational and review resource only. It does not provide or operate any real-money online casino or gambling services, and it is not a licensed gambling operator. Any real-money gambling activity you may undertake occurs exclusively with Third-Party Services subject to their own terms and licences.

Account Registration

The Website may allow or in future introduce the option to create a User Account for additional features (such as subscribing to newsletters, saving favourites, or posting comments). This section applies to any such Account functionality and does not relate to gambling accounts with The Ville Resort-Casino or other Third-Party Services.

Eligibility and age requirements

  • Minimum age: You must be at least 18 years of age to create an Account or submit User Content on the Website. By registering, you represent and warrant that you are 18 years or older and have full legal capacity to enter into these Terms.
  • Local law compliance: You are responsible for ensuring that accessing information about gambling or casinos is lawful in your jurisdiction. If you are under the legal age for viewing gambling-related content in your jurisdiction, you must not use the Website.

Account creation process

  1. Registration details: To create an Account, you may be asked to provide basic contact information such as your name, email address, and country of residence, and to select a password or use a supported sign-in method.
  2. Email verification: The Operator may require you to verify your email address by clicking a confirmation link sent to the address you provide. Until verification is completed, access to certain features may be restricted.
  3. KYC and identity checks: The Website is not a gambling service and generally does not require full KYC procedures. However, the Operator reserves the right to request identification documents (e.g. proof of age, government-issued ID) where reasonably necessary to:
    • Confirm that you are at least 18 years old;
    • Comply with any Applicable Law (including AML/CTF considerations for any financial interaction, if introduced in the future); or
    • Investigate suspected misuse, fraud, or abuse of the Website.

User obligations

  • Accuracy of information: You must ensure that all information you provide is true, current and complete and must promptly update it if it changes. The Operator may suspend or terminate your Account if it reasonably believes that the information you have provided is false, misleading or incomplete.
  • Password and access security: You:
    • Must keep your password and login credentials confidential;
    • Must not share your Account with any other person;
    • Are responsible for all activities that occur under your Account, whether or not authorised by you.
  • Unauthorised use: You must immediately notify the Operator (via the contact details in the "Contact Information" section) if you suspect any unauthorised access to your Account or any other security breach.
  • Prohibited behaviour: You must not create Accounts on behalf of others, use bots or automated scripts to register or log in, or seek to circumvent any technical or security measures implemented on the Website.

Clarification: Any separate registration, KYC or account opening processes relating to The Ville Resort-Casino in Townsville or any other land-based or online casino are conducted directly by those operators, subject to their own regulatory obligations under Queensland and Australian law, and are entirely independent from the Website.

Betting & Gameplay Rules

The Website itself does not accept Bets, provide gaming machines or table games, or host any interactive gambling products. This section therefore addresses:

  • The informational nature of any betting or game descriptions published on the Website; and
  • Rules of conduct where the Website provides interactive features (such as comments, forums or chat) related to gambling topics.

Informational content about betting and games

  • No real-money gambling: All descriptions of casino games, table limits, gaming machines, promotions or betting strategies on The Ville are provided for information and educational purposes only. They do not constitute:
    • An offer to provide gambling services;
    • Financial advice, legal advice or a recommendation to gamble; or
    • A representation that any particular outcome or return is likely or guaranteed.
  • Third-party rules apply: If you choose to visit The Ville Resort-Casino in Townsville or any other Third-Party Service, the rules applying to:
    • Minimum and maximum Bets or Wagers;
    • Game rules, house rules, and table conduct;
    • Bonus eligibility and redemption;
    • Refund or cancellation of Bets;
    are solely those of the relevant licensed operator under its governing laws and licence conditions (e.g. under the Casino Control Act 1982 (Qld) for Breakwater Island Limited).

Cancellation and modification of bets

Because no Bets or Wagers are taken on the Website, the Operator:

  • Cannot cancel, void or modify any Bets you place with a Third-Party Service; and
  • Is not responsible for any errors, disputes or outcomes relating to your gambling activity with those Third-Party Services.

Any rights concerning cancellation or modification of Bets, including in cases of apparent error, system malfunction or responsible gambling interventions, arise solely from your agreement with the relevant Third-Party Service and its regulator.

Conduct in interactive areas (live chat, comments, forums)

  • Respectful behaviour: Where the Website allows comments, forums, messaging or other user-to-user interactions, you must:
    • Refrain from insults, harassment, discrimination, hate speech, or threats;
    • Not post defamatory, obscene, or unlawful content;
    • Respect the privacy and personal information of others.
  • No promotion of illegal gambling: You must not:
    • Advertise or promote unlicensed or illegal gambling operations, including any website falsely claiming to be "The Ville Online" or offering online casino services under The Ville brand; or
    • Encourage others to circumvent Australian gambling laws or regional restrictions.
  • No fraud or misrepresentation: You must not:
    • Impersonate The Ville Resort-Casino, Breakwater Island Limited, the Morris Group or any other person or entity;
    • Publish misleading or fraudulent claims about bonuses, payouts or systems for "guaranteed wins";
    • Solicit money, account details, or personal information from other Users.
  • Moderation rights: The Operator may, at its discretion and without prior notice:
    • Edit, refuse to publish or remove any User Content;
    • Restrict, suspend or terminate your access to interactive features where it reasonably believes you have breached these Terms or Applicable Law.

Bonus Terms

The Website does not itself grant real-money Bonuses, free credits or gambling accounts. However, The Ville may describe or link to bonuses or promotions offered by Third-Party Services, including licensed Australian land-based casinos.

Nature of bonus information on the Website

  • Informational only: Any references on the Website to:
    • Welcome offers, free spins, match bonuses or loyalty programs;
    • Hotel or resort packages, dining vouchers, or entertainment promotions at The Ville Resort-Casino;
    are informational summaries based on publicly available information or materials provided by the relevant operator at the time of writing and may not reflect current terms.
  • No guarantee of availability: The Operator does not guarantee that any Bonus, offer or promotion described on the Website will be:
    • Available to you;
    • Available at the time you visit the venue or website of a Third-Party Service;
    • Suitable for your circumstances or jurisdiction.

Bonus activation and wagering (Third-Party Services)

If you accept a Bonus from a Third-Party Service, your rights and obligations will be governed solely by that provider's terms. Typically these may include (for example only):

  • Wagering requirements: A requirement to wager Bonus funds or winnings a certain number of times (e.g. 20x, 30x) before they can be withdrawn.
  • Time limits: A requirement to use the Bonus or complete wagering within a defined timeframe (e.g. 7 - 30 days), failing which the Bonus and/or associated winnings may expire.
  • Game restrictions: Certain games or bet types may be excluded from wagering or may contribute only partially to wagering requirements.
  • Stake limits: Maximum Bet limits while wagering may apply.

You must read and agree to the applicable terms on the Third-Party Service's own site or venue materials before accepting any Bonus.

Prohibited actions and combining promotions

  • Abuse and exploitation: The Website does not condone Bonus abuse, chip dumping, collusion or other conduct that breaches the terms of licensed operators or Applicable Law.
  • Combining offers: Any ability to combine multiple promotions, loyalty benefits or offers is determined entirely by the Third-Party Service. The Operator of the Website has no authority to interpret or vary those rules.
  • Misrepresentations: You must not present summaries from the Website as official or binding Bonus terms. In any conflict between the Website's descriptions and a Third-Party Service's official terms, the latter prevail.

Responsible gambling note: Bonuses may encourage extended play and can increase financial risk. You should always consider your personal circumstances and use harm-minimisation tools offered by licensed operators and relevant support services in Australia.

Payments & Withdrawals

The Website is an informational resource and does not process real-money gambling transactions. This section clarifies the limited circumstances in which you may make or receive payments in relation to the Website, and the separation between those and any gambling transactions with Third-Party Services.

Payments related to the Website

  • Access to content: The core review content of The Ville is currently provided free of charge. If, in the future, the Operator introduces paid features (e.g. premium reports, subscriptions, or advertising services), those will be subject to additional specific terms displayed at the point of purchase.
  • Accepted methods (if introduced): Any payments to the Website (such as for advertising or premium content) may be accepted via:
    • Credit or debit cards;
    • E-wallets or local Australian payment methods;
    • Bank transfer; or
    • Other methods clearly stated at the time of payment.
    The Operator will identify any applicable fees, processing times and refund policies at or before the time of transaction.

No handling of gambling funds

  • No deposits or withdrawals: The Operator does not:
    • Accept or hold gambling deposits for Users;
    • Process withdrawals of gambling winnings; or
    • Act as an intermediary for payments to or from any casino, bookmaker or other Third-Party Service.
  • Third-party payment terms: Any deposits, withdrawals, chargebacks, disputes or transaction fees associated with your real-money gambling activity are solely between you and the Third-Party Service, such as Breakwater Island Limited for in-venue transactions at The Ville Resort-Casino, governed by their terms and the requirements of AUSTRAC and other regulators.

Refunds relating to the Website

  • Digital services: If the Operator offers any paid digital content or services, your rights to refunds or remedies will be determined by:
    • The specific terms of the relevant product or service; and
    • Your non-excludable rights under the Australian Consumer Law (ACL), where applicable.
  • No refund of Bets or Bonuses: The Operator has no capacity to:
    • Refund Bets or Wagers placed with Third-Party Services;
    • Reinstate or adjust Bonuses or loyalty points issued by those Third-Party Services.

Limitation of Liability

This section sets out important limitations on the Operator's liability to you in connection with your use of the Website, to the fullest extent permitted by Applicable Law (including the ACL). Nothing in these Terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded.

Operator's obligations

  • Information quality: The Operator uses reasonable efforts to:
    • Ensure that factual information about The Ville Resort-Casino and other referenced venues is accurate and up to date as at the time of publication;
    • Correct significant errors brought to its attention within a reasonable period.
  • No guarantee of completeness: The Operator does not warrant that:
    • The Content is complete, current or free from errors; or
    • All promotions, facilities, licences or regulatory details described remain unchanged at the time of your visit or use.

Exclusions of liability

  • Indirect and consequential loss: To the maximum extent permitted by law, the Operator is not liable for any:
    • Loss of profits, revenue, opportunity, business or goodwill;
    • Indirect, special or consequential loss or damage;
    • Loss arising from reliance on information on the Website when deciding whether, where or how to gamble.
  • Technical issues: Without limiting the above, the Operator is not responsible for:
    • Technical failures, interruptions, delays, errors or omissions in the operation of the Website;
    • Network outages, device failures, viruses or malicious code affecting your access;
    • Corruption or loss of data or Content.
  • Third-party conduct: The Operator is not liable for:
    • Acts or omissions of Third-Party Services, including land-based casinos and external websites;
    • Misrepresentations, unlawful conduct or breaches of contract by such Third-Party Services;
    • Any gambling losses, disputes about payouts, or regulatory sanctions affecting those Third-Party Services.

Maximum liability

  • Cap on damages: To the extent the Operator is found liable to you in connection with the Website and where it is lawful to limit that liability, the Operator's aggregate liability for all claims arising out of or in connection with your use of the Website during any 12-month period is limited to the greater of:
    • AU$100; or
    • The total amount (if any) paid by you to the Operator for access to paid Website services during that 12-month period.
  • Gambling-specific clarification: For the avoidance of doubt, any reference to "Bet", "Wager" or "amount of the bet" in typical gambling terms is inapplicable to the Website, as the Operator does not accept Bets. Accordingly, no compensation is payable by the Operator in relation to the outcome of any Bet or Wager placed with a Third-Party Service.

Australian Consumer Law note: If the ACL applies, you may be entitled to certain guarantees and remedies which cannot be excluded. Where a breach of such a guarantee occurs, and it is lawful to do so, the Operator's liability is limited, at its option, to supplying the services again or paying the cost of having the services supplied again.

Intellectual Property Rights

All intellectual property rights in and to the Website and its Content are reserved as set out below.

Ownership of content

  • Operator's materials: Unless stated otherwise, the Operator owns or is licensed to use all copyright, trademarks, trade names, domain names, design rights, database rights and other intellectual property rights in:
    • The Website and its underlying software and code;
    • Textual content including reviews, editorial content, ratings and guides in The Ville;
    • Logos, graphics, layouts, user interface elements and other visual materials.
  • Third-party rights: The names "The Ville" and "The Ville Resort-Casino", associated logos, images of the venue, and other branding elements may be protected by intellectual property rights owned by Breakwater Island Limited, the Morris Group or other third parties. Use of such marks on the Website is for descriptive and nominative purposes only and does not imply endorsement, sponsorship or affiliation.

Permitted use

  • Personal, non-commercial use: You may:
    • Access and view the Website and its Content;
    • Print or download reasonable extracts of Content for your own personal, non-commercial use;
    • Share links to public pages of the Website, provided you do not misrepresent your relationship with the Operator.

Prohibited use

  • No copying or redistribution without consent: Except as expressly permitted above, you must not, without the Operator's prior written permission:
    • Copy, reproduce, publish, republish, upload, post, transmit or distribute any Content;
    • Sell, license, rent or otherwise exploit any Content for commercial purposes;
    • Create derivative works from, or publicly display or perform, the Content.
  • No scraping or automated extraction: You must not:
    • Use bots, crawlers, scrapers or similar tools to systematically extract data from the Website beyond what is permitted by standard search engine indexing;
    • Frame or deep-link to the Website in a way that misleads Users as to the source of the Content.

User content

  • Licence granted: By submitting User Content, you grant the Operator a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to use, reproduce, adapt, publish, translate, create derivative works from, distribute and display such User Content in connection with the operation, promotion and improvement of the Website.
  • Warranty: You warrant that you have all necessary rights to grant the above licence and that your User Content does not infringe the intellectual property or other rights of any third party.

Privacy & Data Protection

Your privacy is important. The Operator collects, uses and discloses personal information in accordance with its Privacy Policy and Applicable Law (including, where relevant, the Privacy Act 1988 (Cth) and the Australian Privacy Principles).

  • Privacy Policy reference: Details of:
    • What personal information is collected (e.g. contact details, usage data, cookies);
    • How that information is used (e.g. to operate the Website, improve content, comply with legal obligations);
    • When information may be shared with service providers or regulators; and
    • Your rights to access, correct or complain about handling of your data;
    are set out in the Privacy Policy available on the Website. You should read that document carefully as it forms part of these Terms.
  • Consent and cookies: By using the Website, you consent to the use of cookies and similar technologies as described in the Privacy Policy or any cookie notice presented to you.

If you follow links to Third-Party Services (including The Ville Resort-Casino's own website or booking platforms), their privacy policies will govern how they handle your personal information. The Operator is not responsible for the privacy practices of those third parties.

Changes to Terms

The Operator may update, amend or replace these Terms from time to time to reflect legal, technical or business developments, regulatory changes in Australia or Queensland, or modifications to the Website's functionality.

Notification of changes

  • Methods of notice: Where changes are material, the Operator will take reasonable steps to notify Users, which may include:
    • Posting a prominent notice or banner on the Website;
    • Updating the "last updated" date at the top or bottom of these Terms;
    • Sending an email to registered Users (if email addresses are available).
  • Effective date: Unless otherwise stated, changes take effect when they are published on the Website. Continued use of the Website after changes are published constitutes your acceptance of the revised Terms.

Your options in case of disagreement

  • Discontinue use: If you do not agree with any updated Terms, you must stop using the Website and, if you have an Account, you may request its closure.
  • Access to previous versions: For regulatory and transparency reasons, the Operator may retain archived versions of prior Terms, which may be made available upon reasonable written request, subject to legal and operational constraints.

Termination & Suspension

The Operator may restrict your access to the Website and/or terminate any Account you hold in accordance with this section.

Grounds for suspension or termination

  • Breach of Terms or law: The Operator may suspend or terminate your Account or access where it reasonably believes you have:
    • Breached these Terms or any applicable policy (e.g. Privacy Policy, community guidelines);
    • Used the Website in a manner that is unlawful, fraudulent, defamatory or harmful to others;
    • Promoted or facilitated illegal or unlicensed gambling operations, including impersonation of The Ville Resort-Casino online.
  • Security and technical reasons: Suspension may also occur where necessary to:
    • Protect the integrity or security of the Website; or
    • Perform maintenance or respond to technical issues.
  • Discontinuation of Website or features: The Operator may discontinue the Website or any part of it, or cease offering Accounts or certain features, at any time.

Procedure and effects

  • Notice: Where reasonably practicable and lawful, the Operator will provide notice (for example by email or on-screen notification) of suspension or termination, stating the main reason, particularly where it is not urgent or security-related.
  • User-initiated closure: You may close your Account at any time by following any available self-service process or by contacting the Operator as set out in the "Contact Information" section.
  • Consequences: Upon termination:
    • Your right to access any Account-restricted features ceases immediately;
    • Some or all of your User Content may be removed, anonymised or retained as required by law and for legitimate business purposes (e.g. record-keeping, dispute resolution).
  • No effect on gambling accounts: Termination of your Website Account does not terminate or affect any separate accounts or rights you may have with Third-Party Services, which must be managed directly with those providers under their terms and conditions.

Governing Law & Jurisdiction

This section clarifies the law governing these Terms and the mechanisms for resolving any disputes arising from or relating to your use of the Website.

Applicable law

  • Governing law: These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws in force in the State of Queensland, Australia, and, where applicable, the laws of the Commonwealth of Australia.
  • Regulatory context: While the Website itself is not a gambling operator, information presented may refer to regulatory frameworks including the Casino Control Act 1982 (Qld), Casino Control Regulation 1999 (Qld), AUSTRAC AML/CTF requirements and related instruments. Such references are for informational purposes only and do not constitute legal advice.

Dispute resolution

  1. Internal resolution: If you have a concern or complaint about the Website, you should first contact the Operator using the details in the "Contact Information" section, providing:
    • Your name and contact details;
    • A clear description of the issue; and
    • Any relevant supporting documentation (e.g. screenshots).
    The Operator will use reasonable efforts to respond within a reasonable time.
  2. Court proceedings: Subject to any mandatory laws to the contrary, you and the Operator agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia, and any courts competent to hear appeals from those courts, in respect of any dispute arising out of or relating to these Terms or the Website.
  3. Consumer protection bodies: This clause does not prevent you from making a complaint to any governmental or regulatory authority (such as an Australian consumer protection agency) where you are entitled to do so under Applicable Law.

Note on gambling disputes: Any dispute relating to actual gambling activity (including gaming machine outcomes, table game disputes, payouts or self-exclusion issues) at The Ville Resort-Casino or other licensed venues must be raised directly with the relevant operator and, if necessary, with the appropriate regulator (e.g. the Office of Liquor and Gaming Regulation (OLGR) in Queensland). The Operator of the Website is not a party to such disputes.
